Terms of Service

These terms govern use of the Sailz service. If you signed a separate agreement or pilot agreement with us, that document controls where the two disagree.

1. What we provide

Sailz configures, hosts and operates a set of AI agents for your business. Which agents, on which plan, is what you agreed at signup. We handle the build, the hosting, the monitoring and the ongoing tuning. You get your own deployment, your own logins and your own data.

2. Plans, billing and usage

Plans are billed monthly in advance, plus a one-time setup fee. Each plan includes a stated allowance of talk minutes and research lookups; usage beyond the allowance is billed at the published overage rate. We will warn you before you cross your allowance, not after. Prices may change with 30 days' written notice, never mid-term on an annual plan.

3. Trial, cancellation and your data

Pilots run 15 days. After that, either side may end the agreement with 30 days' written notice. On termination we export your data to you in a usable format and delete our copy within 30 days. We do not hold your data hostage and we do not charge an exit fee.

4. Your responsibilities

You are responsible for the accuracy of what you teach your agent (prices, hours, services, menus, policies) and for reviewing what it says on your behalf. For outbound calling you are responsible for having a lawful basis to contact every person on any list you upload, and you attest to that at upload. You will not use Sailz to place calls or send messages that violate TCPA, CAN-SPAM, state telemarketing law, or any do-not-call obligation.

5. What the agents will not do

Agents do not give medical, legal or financial advice. Agents do not send email, SMS or public content, change prices, issue refunds or move money without your explicit approval. Agents disclose that they are AI. These are enforced product constraints, not preferences, and we will not disable them on request.

6. Availability and failure

We target 99.5% monthly availability of the agent platform and monitor every deployment continuously. Every client has a fallback number configured and tested before go-live, so that when the AI is unavailable, calls route to a human. We do not control the uptime of upstream providers (telephony, model, calendar) and outages caused by them are excluded from that target. If we miss the target in a month, tell us and we will credit that month pro rata.

7. AI output

AI systems make mistakes. Sailz constrains its agents to refuse rather than guess, holds consequential actions for your approval, and gives you a transcript of everything said. You accept that no configuration makes an AI perfect, and you agree to review the approval queue rather than treat it as a formality.

8. Confidentiality and ownership

Your business data, your call records, your customer information and the knowledge you teach your agent remain yours. The Sailz platform, engine, agent templates and everything we build across clients remain ours. Neither side discloses the other's confidential information.

9. Liability

Except for our confidentiality and data-protection obligations, our total liability in any 12-month period is limited to the fees you paid us in that period. Neither side is liable for indirect or consequential losses. Nothing here limits liability that cannot lawfully be limited.

10. Law

These terms are governed by the laws of the Commonwealth of Virginia, and the courts of Virginia have jurisdiction.
